TERMS OF USE AGREEMENT BETWEEN USER/CLIENT AND Life Well Lived LLC (“The Company”, “Agency”) which consist of Little Palm Travel and Orlando Made Simple. This website is offered to you, the user, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Please read the information carefully. Your access to, and use of, this website constitutes your agreement to all such terms, conditions, and notices. This website is not affiliated with, maintained, authorized, endorsed or sponsored by the Walt Disney Company or any of its affiliates. This is an independent, unofficial site. All information (including prices, dates, times, availability) contained on this site is UNofficial and subject to change without notice. Call Walt Disney World directly or visit their web pages to confirm before your visit.

RISKS AND SAFETY Travel to certain destinations may involve greater risk than others. Client assumes all risks associated with travel. The Company urges you to remain informed about current news events, travel prohibitions, warnings, announcements and advisories issued by the United States Government. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/.  THE COMPANY DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO ANY DESTINATION IS ADVISABLE OR WITHOUT RISK BY OFFERING THE SALE OF TRAVEL AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK. 

LIABILITY Life Well Lived LLC is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Life Well Lived LLC is not responsible for any injury, loss, death, quarantine, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to U.S. standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner's risk. The prices of tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. You specifically agree that Life Well Lived LLC is not liable for any consequential loss or damage.  Life Well Lived LLC HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM Life Well Lived LLC WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY Life Well Lived LLC.

The lead passenger assumes the responsibility of sharing these terms and conditions with each passenger in their group, including payment of all amounts when due. It is the responsibility of each passenger to read our terms and conditions in its entirety. In addition, we reserve the right to modify these Terms and Conditions. If there is any part of these terms and conditions that you do not agree with, please do not use our travel services.

TRAVEL AGENT Life Well Lived, LLC acts as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators, tours and hotels. Life Well Lived, LLC does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Life Well Lived, LLC's obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not Life Well Lived, LLC. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination at https://travel.state.gov/content/travel.html.

IMPORTANT CONDITIONS Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. You expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.

FEES: Planning fees paid to your travel consultant are non-refundable and may not be applied to any portion of your travel expenses.

Cancellation fees may apply, and will be charged using the credit card on file, prior to cancelling any deposited reservations

CANCELLATION Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.

In additional to supplier related cancellation fees, Life Well Lived, LLC may impose cancellation fees for bookings cancelled and not immediately rescheduled.

PAYMENTS You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Life Well Lived, LLC. By submitting a credit card authorization form to Life Well Lived, LLC, you agree to allow Life Well Lived, LLC to use your payment method to purchase travel products from our Suppliers on your behalf. EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF Life Well Lived, LLC OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF Life Well Lived, LLC OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, Life Well Lived, LLC RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to Life Well Lived, LLC in writing. As a result of cancellation, third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund. 

FORCE MAJEURE Life Well Lived, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Life Well Lived, LLC. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

In addition, each of Life Well Lived, LLC’s Suppliers have terms and conditions which include Force Majeure provisions. If a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although Life Well Lived, LLC shall use its reasonable efforts to secure reimbursement for you where possible.

TRAVEL PROTECTION For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. There are many benefits available in high value plans including cancellation penalty reimbursement, delay coverage, baggage loss coverage, medical care, emergency evacuation and more. Additionally, most health insurance policies do not provide medical coverage for international travel. In order for you to obtain coverage for certain pre-existing conditions, your insurance policy must be purchased at the time of booking or shortly there after.  However, Life Well Lived, LLC is not an insurance company and has no responsibility for the submission, payment, denial or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

ADDITIONAL FEES Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in. 

BAGGAGE FEES Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.

 RESPONSIBILITY We always do our best to make sure your travel arrangements are satisfactory. However, Life Well Lived, LLC and its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and independent contractors do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to Life Well Lived, LLC or any of Life Well Lived, LLC's affiliated entities.

COVID-19 You request that Life Well Lived, LLC (“Agency”) and its agents make one or more travel bookings on your behalf. As the worldwide COVID-19 coronavirus pandemic remains ongoing at this time, you acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, these travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity or other third party over which Agency has no control. You further acknowledge that the supplier’s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including your right to receive a refund, in such an event. Moreover, you understand that should you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances. You hereby agree to hold Agency and its agents harmless and release it from any and all liability for any damages, including but not limited to monetary losses, you may incur as a result of such interruption or cancellation of these travel plans.

By purchasing travel through Life Well Lived, LLC, you understand that COVID-19 is a highly contagious virus that can be spread via person-to-person contact. Agency will take reasonable efforts to provide the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in the travel itinerary.
 
As a traveler, you understand that Agency’s supplier(s) may have policies in place to help prevent the spread of COVID-19. Agency is not the drafter or holder of those policies and these policies can change at any time. The supplier(s) may not apply these policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate.
 
Each state/country institutes their own pandemic-protective policies and regulations. As a traveler, you further understand that you are responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all state(s)/country(ies) listed in the travel itinerary, including any policy updates. Entry into another country may be denied for reasons within or outside of anyone’s control. By traveling, you can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s). You are responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all vendors used in your travel itinerary, including any policy updates.

With full awareness of the risks involved, you, for yourself, and on behalf of your traveling companions, including, but not limited to, your family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release travel agency its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering Agency.  You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of Agency services, or the services of Agency’s suppliers or vendors, specifically related to COVID-19.
 

PASSPORTS AND TRAVEL DOCUMENTATION All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for 6 months or longer than your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State, or representative government agency of the country to which you are traveling, to confirm the requirements for visas and/or other requirements for admission to your destination. It is your responsibility to ensure you are aware of any health and legal requirements for your travel destinations and to ensure that you carry all necessary documentation. Travelers with passports that are found to be washed, mutilated, or damaged may be refused entry. U.S. citizens should be aware that countries can deny foreigners entry if they have been charged or convicted of a serious crime.  If you do not have a passport at time of booking, it is your responsibility to secure one and Life Well Lived, LLC is not liable should you not receive it in time, or for any reason. Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A valid government issued ID is required for travel within the USA, however depending on the State of departure or arrival, a passport may be required instead of a driver’s license in addition to health documentation. It is the traveler's responsibility to provide the correct documents and failure to do so may result in being denied entrance or boarding for the flight. Regrettably, we are unable to refund unused flights, hotel, or add-ons because of denied entrance or boarding situations. TRAVEL DOCUMENTS Travel documents including, without limitation, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure.
 

HEALTH AND SPECIAL REQUIREMENTS It is your responsibility to ensure you are aware of any health and legal requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation.

HAZARDOUS MATERIALS Federal law prohibits passengers from bringing hazardous materials on the aircraft.

(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.

(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. INSECTICIDE NOTICE We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. REFUSAL OF SERVICE Service providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler; (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. Life Well Lived, LLC assumes no liability for the acts of the service provider in refusing service.

MARKETING By entering into this Agreement, You understand, acknowledge and accept that You may receive marketing messages from Life Well Lived, LLC, their systems, its agents, partners and affiliates, including newsletters, regarding both services and products. You hereby understand, acknowledge and accept that Life Well Lived, LLC, their systems, partners' systems and/or third party systems may and has/have the right granted by You to send emails and other communications to You on behalf of Life Well Lived, LLC, Advertisers, and other partners and affiliates, including solicitation and service solicitation emails. You may have the ability to change some of Your email settings and preferences. You may always opt-out of receiving future commercial emails and newsletters from The Company by clicking on the “unsubscribe” link within any emails received.

PRIVACY POLICY Life Well Lived, LLC is committed to protecting the privacy and confidentiality of your personal information.

The laws of the State of Georgia govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Hall County, Georgia in all disputes arising out of or relating to travel bookings with Life Well Lived, LLC.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Life Well Lived, LLC with respect to travel bookings made with Life Well Lived, LLC by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Life Well Lived, LLC with respect to communications with Life Well Lived, LLC. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
